Terms of Service

These terms govern your use of Silma ("the Service"), operated by Joonas Soininen, United States. By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

1. Service description

Silma is an AI-powered content intelligence tool for short-form video. The Service includes reel analysis, Pre-Check (AI audit of video frames before posting), Watchlist (monitoring public competitor accounts for content trends), an AI assistant for content strategy, and brand profile tools. The Service is provided to help content creators and businesses understand what makes short-form video effective.

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this requirement. Users under 18 should have parental or guardian consent.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. One account per person; you may not create multiple accounts to circumvent free-tier limits. Notify us immediately at support@silma.app if you suspect unauthorized access.

4. Acceptable use

You agree not to:

Submit URLs for private or unlisted content you do not have the right to analyze
Use the Service to harass, stalk, or infringe on the privacy of others
Attempt to circumvent usage limits, rate limits, or tier restrictions
Resell or redistribute analysis data or AI-generated suggestions commercially without written permission
Use automated tools to abuse the Service beyond the provided API
Upload video content that is illegal, harmful, or infringes on third-party rights
Use the Watchlist feature to monitor private individuals rather than public content creators
Attempt to reverse-engineer, decompile, or extract the underlying systems, prompts, or models that power the Service

5. Uploaded content

You retain ownership of content you upload (video frames, brand documents). You grant us a limited, non-exclusive license to process that content solely to provide the Service to you. We do not use your uploaded content to train AI models. Uploaded video frames are automatically deleted within 48 hours.

6. AI-generated content

The Service uses AI to generate analysis, suggestions, and chat responses. AI output is provided for informational purposes only and is not guaranteed to be accurate, complete, or suitable for your situation. You are solely responsible for how you use AI-generated content. We are not liable for decisions you make based on AI output.

7. Feedback

If you submit feedback, ideas, or suggestions about the Service, you grant us a royalty-free, worldwide license to use that feedback without restriction or compensation to you. You waive any moral rights in such feedback to the extent permitted by law.

8. Subscriptions & billing

Paid plans are billed monthly through Stripe. You can cancel anytime through the billing portal; access continues until the end of your billing period. Refunds are handled on a case-by-case basis. We reserve the right to change pricing with 30 days notice to existing subscribers.

9. Usage limits

Each plan has monthly limits on reel analyses, Pre-Checks, and chat messages. Unused quota does not roll over. We may adjust limits with notice.

10. Intellectual property

You retain ownership of your brand profile, notes, uploaded documents, and any content you create based on our suggestions. Analysis results generated by AI are provided for your use but may not be uniquely original. Social media content analyzed through the Service remains the property of its original creators. The Silma name, product design, and AI assistant persona are our intellectual property.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not affiliated with Instagram, Meta, or TikTok. AI analysis results are not guaranteed to be accurate or complete.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. Our total liability to you for any claims arising from these terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Joonas Soininen, Silma, and their respective successors and assigns from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these terms, or your infringement of any third-party rights.

14. Force majeure

We are not liable for any failure or delay in providing the Service caused by circumstances beyond our reasonable control, including but not limited to third-party infrastructure outages, internet disruptions, natural disasters, or actions of third-party service providers.

15. Termination

We may suspend or terminate your account at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us. Sections 10, 11, 12, and 13 survive termination.

16. Governing law & disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware. If you are a consumer in the EU, you may also have the right to refer a dispute to your local courts or the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

17. Changes to terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email with at least 14 days notice.
